The court also gave the US a week to respond, with the government getting its turn to reply by June 9, 2025.<\/em><\/p>\n<div class=\"ad-placement\">\n<div id=\"82503191-e1d1-435a-874f-9c78a2a54a2f\" class=\"_ap_apex_ad\"><\/div>\n<div id=\"0f7e3106-c4d6-4db4-8135-c508879a76f8\" class=\"_ap_apex_ad\"><\/div>\n<p>\t\t\t\tvar adpushup = window.adpushup  = window.adpushup || {que:[]};<br \/>\n\t\t\t\tadpushup.que.push(function() {<br \/>\n\t\t\t\t\tif (adpushup.config.platform !== &#8220;DESKTOP&#8221;){<br \/>\n\t\t\t\t\t\tadpushup.triggerAd(&#8220;0f7e3106-c4d6-4db4-8135-c508879a76f8&#8221;);<br \/>\n\t\t\t\t\t} else {<br \/>\n\t\t\t\t\t\tadpushup.triggerAd(&#8220;82503191-e1d1-435a-874f-9c78a2a54a2f&#8221;);<br \/>\n\t\t\t\t\t}<br \/>\n\t\t\t\t});<\/p><\/div>\n<p>The United States Court of International Trade normally flies under the radar, but it burst into the spotlight yesterday by determining <a href=\"https:\/\/www.carscoops.com\/tag\/donald-trump\/\">President Trump<\/a> exceeded his authority by applying broad tariffs worldwide \u2013 even on uninhabited islands.<\/p>\n<p>While there\u2019s a lot to unpack, the court determined \u201cThe Constitution assigns Congress the exclusive powers to \u2018lay and collect Taxes, Duties, Imposts and Excises,\u2019 and to \u2018regulate Commerce with foreign Nations.\u2019\u201d <\/p>\n<p>They also found that Trump\u2019s use of the International Emergency Economic Powers Act of 1977 (IEEPA) does not confer \u201cunbounded authority\u201d to \u201cimpose unlimited tariffs on goods from nearly every country in the world.\u201d Given this, it\u2019s not surprising to learn the tariffs challenged in the lawsuit were ordered to be put aside.<\/p>\n<div id=\"taboola-mid-article\"><\/div>\n<div id=\"taboola-mid-article-thumbnails-organic\"><\/div>\n<p><strong>More: <a href=\"https:\/\/www.carscoops.com\/2025\/03\/trump-to-hit-all-non-us-made-vehicles-with-25-tariff\/\">Trump Imposes Sweeping 25% Tariff On Non-US Made Cars And Parts<\/a><\/strong><\/p>\n<p>While that\u2019s the gist of the <a href=\"https:\/\/www.cit.uscourts.gov\/sites\/cit\/files\/25-66.pdf\">50 page ruling<\/a>, the court went on to say \u201cThe Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariff.\u201d This is because they \u201cdo not deal with the threats set forth in those orders.\u201d<\/p>\n<p>        <a href=\"https:\/\/www.carscoops.com\/wp-content\/uploads\/2025\/05\/Trump-529-2.jpg\" data-type=\"inarticle-image-block\"> <\/p>\n<figure class=\"wp-block-image size-large\">\n<p>                    <img loading=\"lazy\" class=\"lazy \" src=\"\" alt=\" Court Strikes Down Most Of Trump\u2019s Tariffs, But Appeals Court Hits Pause\" width=\"2500\" height=\"1667\" data-src=\"https:\/\/www.carscoops.com\/wp-content\/uploads\/2025\/05\/Trump-529-2-1024x683.jpg\" data-type=\"inarticle-image\" \/><\/p>\n<\/figure>\n<p>        <\/a>  <\/p>\n<h4 class=\"wp-block-heading\">White House<\/h4>\n<p>This sets up another showdown as the Trump administration has reportedly filed an appeal. The <a href=\"https:\/\/apnews.com\/article\/trump-tariffs-trade-court-0392dbd59f548e49ad4f64254ae3f94a\">Associated Press<\/a> reports the \u201cSupreme Court will almost certainly be called upon to lend a final answer,\u201d so that means the question of tariffs could be decided by a court that leans to the right.<\/p>\n<p>While the ruling shot down a number of tariffs, it didn\u2019t get rid of all the ones imposed by President Trump. Notably, the 25% tariff on imported cars and parts remain in effect as the administration used the Trade Expansion Act of 1962.
